NOTICE OF INVITATION FOR BID

Notice is hereby given that sealed bids will be received by Jackson County Port Authority
until 2:00 PM on Tuesday, May 15, 2018 and then said bids will be opened and read
aloud at the office of the Jackson County Port Authority at 3033 Pascagoula Street,
Pascagoula, Mississippi 39567 and designated as Bid for the Following described, to wit:

All bids must be on file with Jackson County Port Authority, 3033 Pascagoula Street,
Pascagoula, Mississippi 39567 on or prior to the hour and date first mentioned above, and
must be sealed.

Contractors have the option of submitting their bids sealed in an envelope to the Jackson
County Port Authority or electronically through www.centralbidding.com. Official Plans
and Specifications may be obtained through a downloaded version from Central Bidding
or a printed copy through the offices of Burk-Kleinpeter-Lunsford Engineers / Architect,
PLLC, 917 Western America Circle, Suite 101, Mobile, Alabama 36609. A printed copy
may be obtained upon payment of $370.00 non-refundable printing cost/fee for each
set. Overnight mailing of Bidding Documents will not be provided. Please contact
Central Bidding at 225-810-4814 for any questions relating to the electronic downloads
and bidding process.

SUBMITTAL OF SEALED BIDS: Each bid must be submitted in duplicate with bid
security in accordance with the instructions to bidders which are bound in the
Project Manual. The Owner reserves the right to waive irregularities and to reject
any or all bids.

SUBMITTAL OF ELECTRONIC BIDS: Each electronically submitted bid must be
submitted in “pdf” format and shall contain the same information and forms as required
for the paper bids. Note – electronic bids must be secured with a bid bond. When
submitting a bid electronically, the authorized signature may be typed or be an electronic
signature. In the event that an electronically submitted bid has a corrupted attachment, the
bid will be considered null and void.

When bids are submitted electronically, the requirement for including a certificate of
responsibility, or a statement that the bid enclosed does not exceed Fifty Thousand
Dollars ($50,000.00), on the exterior of the bid envelope shall be deemed in compliance
by including the same information as an attachment with the electronic bid submittal.

A Pre-Bid meeting will be held at 1:00 PM on Thursday, April 26, 2018. The Pre-Bid
meeting will be conducted at the Jackson County Port Authority office at 3033
Pascagoula Street, Pascagoula, Mississippi. If you have any questions, please contact

Resident contractors shall, in accordance with the laws of the State of Mississippi, be
granted preference over non-residents in the award of the contract in the same manner
and to the same extent as provided by the laws of the state of domicile of the nonresident.
A non-resident contractor shall attach to his bid proposal a copy of his resident
state’s current law pertaining to such state’s treatment of non-resident contractors. If the
state of residence of the Contractor has no such law, then a statement BY AN OFFICER
OF THE COURT indicating the State of (Name of State) has no resident Contractor
preference law shall be submitted with the Bid Form. Failure by a non-resident bidder to
submit either of the information required herein shall disqualify Contractor’s bid and
same will not be considered. Any bid submitted by a non-resident contractor which does
not include the non-resident contractor’s current state law shall be rejected and not
considered for award.

Minority and women’s business enterprises are solicited to bid on this contract as prime
contractors and are encouraged to make inquiries regarding potential subcontracting
opportunities and equipment, material and/or supply needs.
A certified check or bank draft payable to the order of Jackson County Port Authority,
negotiable U.S. Government bonds (at par value), or a satisfactory Bid bond executed by
the Bidder and an acceptable surety, must be submitted in an amount equal to five percent
(5%) of the total bid for:

All bids submitted in excess of $50,000.00 by a prime or subcontractor to do any
erection, building, construction, repair, maintenance or related work, must comply with
Section 31-3-21, Mississippi Code of 1972, by having a current Certificate of
Responsibility from the State Board of Public Contractors. The current Certificate of
Responsibility Number shall be indicated on the exterior of the sealed bid envelope
before it can be opened.

ALL BIDS SUBMITTED FOR $50,000.00 OR LESS SHALL BE SO MARKED ON
THE EXTERIOR OF THE SEALED BID ENVELOPE OR NOTED ON YOUR
ELECTRONIC BID SUBMISSION

The Jackson County Port Authority and the Board of Supervisors reserve the right to
reject any and all bids received and to award said bid in the best interest of the County
and Port Authority. Bids may be held for a period not to exceed sixty (60) day from the
date of the opening of bids, and cannot be withdrawn after the scheduled closing time for
the Project for a period of sixty (60) days, for the purpose of reviewing the bids and
investigating the qualifications of Bidders, prior to awarding of the contract.

Section 3
This project is covered by the requirements of Section 3 of the Housing and Urban
Development Act of 1968 (12 U.S.C. § 1701u) (“Section 3”). Section 3 requires that
when employment or contracting opportunities are generated by HUD-funded projects,
preference is given to low to very low-income persons and businesses residing in the
community where the project is located. Section 3 businesses are encouraged to submit a
bid as any responsive, responsible bidder that qualifies as a Section 3 Business Concern
will be given a preference during evaluation. A bidder selected for this Project will be
responsible for ensuring compliance with all Section 3 requirements including, but not
limited to, the hiring and contracting decisions made on the Project.

This procurement will be subject to all applicable sections of the Mississippi Code of
1972, Annotated. Specifically, Mississippi Code of 1972, Section 31-5-37 (2012) “All
public works projects utilizing funds received by state or local governmental entities
resulting from a federally declared disaster or a spill of national significance, including
damages, penalties, fines or supplemental projects paid or financed by responsible parties
pursuant to a court order, negotiated settlement, or other instrument, including under any
law distributing such fines and penalties including the federal Resources and Ecosystems
Sustainability, Tourist Opportunities and Revived Economy of the Gulf Coast Act of
2011 (R.E.S.T.O.R.E.), the Oil Pollution Act of 1990 or the Federal Water Pollution
Control Act or similar legislation, shall be subject to the hiring policies established by
this section.” By bidding on this project, contractor certifies and agrees to comply with
this law. The law also requires contractors submitting bids for public works projects
utilizing specified funding to submit the required Mississippi Department of Employment
Security employment plan WITHIN SEVEN (7) DAYS OF THEIR BID BEING
AWARDED.
