RESTAURANT, BAR/LOUNGE, AND GIFT SHOP CONCESSIONAIRE
Notice is hereby given that the Lafayette Airport Commission (LAC) will receive sealed Proposals until 9:00 a.m. on Monday, August 3, 2020, at the offices of the Lafayette Airport Commission, 222 Tower Drive, Lafayette, LA 70508-2124, for Restaurant, Bar/Lounge, and Gift Shop Concessionaire for the LFT New Terminal Facility, in accordance with the terms and conditions and specifications set forth in this solicitation. Proposals received after the above stated date and time will be returned unopened to the sender.
The Proposer must have a minimum of five (5) years’ experience as a concessionaire and capable of operating a high-quality food, restaurant, bar/lounge, and gift shop operations; airport concessionaire experience is preferred.
The Request for Proposals, which includes the scope of work and operations, instructions to proposers, general information, general conditions of development, and exhibits/appendices, may be obtained at the offices of the Lafayette Airport Commission, 222 Tower Drive, Lafayette, Louisiana 70508, (337) 266-4401, Monday through Friday, 8:00 a.m. - 4:00 p.m. Each interested party requesting a printed Request for Proposals will be required to submit, to the LAC, a $50.00 non-refundable deposit to cover the cost of reproduction. The Request for Proposals in PDF format, at no cost, may be obtained by sending an email request to Jennifer Comeaux at firstname.lastname@example.org. The Request for Proposals is also available online and proposals may also be submitted online at: https://www.centralauctionhouse.com. Use only original proposal forms which are part of the Request for Proposals. The LAC does not assume any responsibility for errors or misinterpretations resulting from the use of incomplete sets of the Request for Proposals.

A non-mandatory pre-proposal conference will be held on Thursday July 16, 2020 at 2:00 p.m. in the Conference Room of the Lafayette Airport Commission Administration Building, 222 Tower Drive 70508. A call-in option is available for attendance at the pre-proposal conference. Toll-free call-in numbers is (877)853-5247. As the LFT New Terminal Facility is an active construction site, only a plan review will be available and will be reviewed at the pre-proposal conference. No other plan reviews will be conducted outside of the pre-proposal conference, unless at the request of the LAC. All prospective proposers are highly encouraged to attend. Important operational and security information which may affect proposals will be presented at this meeting. Any questions regarding the Request for Proposals, are recommended to be submitted, in writing, prior to the pre-proposal meeting. The LAC reserves the right to waive any irregularities in any proposal, to reject any or all proposals, to re-advertise for proposals, and to accept the proposal which, in the judgment of the LAC, even though it does not offer the greatest direct financial income, is nevertheless deemed the most advantageous for the public and the LAC, i.e., the most responsible proposal.
Each proposal must be accompanied by a proposal security (certified check, cashier’s check, proposal bond, letter of credit) for an amount equal to five percent (5%) of the proposed Minimum Annual Guarantee. MONEY ORDERS WILL NOT BE ACCEPTED. If a bond is used, it must be written by a surety or insurance company currently on the U.S. Department of the Treasury Financial Management Service list of approved bonding companies which is published annually in the Federal Register or by a Louisiana domiciled insurance company with at least an A- rating in the latest printing of the A.M. Best’s Key Rating Guide to write individual bonds up to ten percent (10%) of policyholders’ surplus as shown in the A.M. Best’s Key Rating Guide or by an insurance company in good standing licensed to write bonds which is either domiciled in Louisiana or owned by Louisiana residents.
It is the policy of Lafayette Airport Commission (LAC) as defined in 49 CFR Part 23 to create a level playing field on which ACDBEs can compete fairly for opportunities. Accordingly, the LAC has established an ACDBE Participation Goal of 2.66% of annual gross revenue for this solicitation.
Proposers on this solicitation must meet all of the requirements of 49 CFR Parts 23 and 26 and the certification requirements of the Louisiana Department of Transportation and Development (LaDOTD). The ACDBE program requirements set forth in the Federal Disadvantaged Business Enterprise Program for the LAC shall apply to this solicitation.
In compliance with the LAC’s ACDBE Policy and the federal regulations under 49 CFR Part 23, to be eligible for award of a contract, the master concessionaire/prime proposer MUST either:
Meet the ACDBE goal as advertised with meaningful ACDBE participation through direct participation with ACDBE Joint Venture partners or subtenants;
Meet the ACDBE goal as advertised with meaningful ACDBE participation through indirect participation by ACDBE suppliers of goods and services; OR
Demonstrate Good Faith Efforts to meet the ACDBE goal.
All firms participating on LAC concessions projects, including ACDBE and non-ACDBE firms, MUST be documented on the Contract Participation and ACDBE Commitment Form 1. This form must be submitted by the selected Proposer, must include all information requested and must be signed by an authorized signatory.
The ACDBE firms proposed on this form are binding. Any substitutions or removals of ACDBE firms listed on this form after submission must be requested through the formal process of contract amendment and be approved by the DBE Liaison Officer. The concessionaire shall, within thirty (30) days from the execution of a contract with the LAC, execute formal contracts, operating agreements, leases and/or purchase orders with the ACDBE(s) included on the Contract Participation and ACDBE Commitment Form 1.
For each participating ACDBE firm, an ACDBE Participation Questionnaire Form 2 MUST be included and signed by an authorized signatory of the ACDBE firm.
If the Proposer has not attained the ACDBE goal established for the project, Documentation of Good Faith Efforts Form 3 MUST be submitted. The completed form along with all required supporting documentation must be furnished.
A Statement of Intent to Perform, ACDBE Form 4, is also required for submission by each ACDBE Firm listed on the ACDBE Commitment Form 1. The Letter of Intent must be signed by an authorized representative of the DBE Firm and the Proposer.
For airport concessions contracts, ALL Proposers must submit complete and accurate ACDBE Compliance Forms 1, 2, 4, and/or 3, as applicable with their Proposals as a measure of responsiveness.
Should a proposer fail to comply with the submission of complete and accurate ACDBE Compliance Forms demonstrating attainment of the ACDBE Goal or Good Faith Efforts to attain the ACDBE goal, the Proposal shall be deemed non-responsive and rejected by the LAC.
In order to receive credit for ACDBE participation the proposed firms must be ACDBE certified by the Louisiana Unified Certification Program (LAUCP) prior to the proposal deadline. Only businesses certified through the LAUCP are eligible for participation in the ACDBE opportunities for the project. A listing of eligible firms can be found at http://www8.dotd.la.gov/UCP/UCPSearch.aspx.
The LAC affords no preference based upon the geographical area in which an ACDBE firm is located, provided the firm is listed in the LAUCP directory.
The LAC shall have the authority to investigate allegations of discriminatory practices of proposer(s) who contract or seek to contract with the LAC.
Please direct all questions related to ACDBE compliance prior to submission of the solicitation to the LAC’s Disadvantaged Business Enterprise Liaison Officer.
The successful Proposer shall be required to furnish a Performance Bond equal to the amount of the required minimum capital investment during the initial buildout period and a Performance Bond equal to the Minimum Annual Guarantee during operations, written by a surety or insurance company licensed to do business in Louisiana, and who is currently on the U.S. Department of the Treasury Financial Management Service List of approved bonding companies which is published annually in the Federal Register, or by a Louisiana domiciled insurance company with at least an A- rating in the latest printing of the A.M. Best’s Key Rating Guide to write individual bonds up to ten percent (10%) of policyholders’ surplus as shown in the A.M. Best's Key Rating Guide, or by an insurance company that is either domiciled in Louisiana or owned by Louisiana residents and is licensed to write surety bonds.
All Proposers will be required to provide written certification that they will comply with the Lafayette Regional Airport security requirements.
