Bid Law Requirement Update: Act 406
Vendors will be required to submit certain documentation with SOQ submission, i.e. affidavits, proof of insurance, etc. These requirements will be outlined specifically in the instructions of each SOQ package. Vendors should continue to carefully read and respond accordingly per the requirements of the SOQ packages. These changes are pursuant Louisiana Public Bid Law more specifically, Act 406 of the 2016 Louisiana Legislative Regular Session. To Provide Services to Develop a Parish-Wide Cost Allocation Plan.
 
 
The Parish of Jefferson, authorized by Resolution No. 142162 is hereby soliciting Statements of Qualifications from experienced firms interested in providing services to develop a Parish-wide Cost Allocation Plan and a departmental cost allocation plan which identifies the various costs incurred by the General Fund to support and administer services for non-General Fund programs as well as a departmental cost allocation plan for the District Attorney’s Office to support and administer the Child Support program based upon audited financial statements for the years 2023, 2024 and 2025.
 
Deadline for Submissions: 3:30 p.m., July 28, 2023
 
 
The following criteria shall be used to evaluate the Statements of Qualification the firms/individuals submitting:
 
Professional training and experience, particularly in the cost allocation area (20 points).
Past and current professional accomplishments in developing Indirect Cost Plans for other jurisdictions including at least three references (20 points).
Capacity to complete engagement in a timely manner (20 points).
Extensive experience in negotiating with state and federal agencies (20 points).
Proposed fee schedule. (20 points). 
The person or firm submitting a Statement of Qualifications (General Professional Services Questionnaire) must identify all subcontractors who will assist in providing professional services for the project in the General Professional Services Questionnaire. Each subcontractor shall be required to submit a General Professional Services Questionnaire and all documents and information included in the questionnaire. (Refer to Jefferson Parish Code Ordinance, Section 2-928)
 
All persons or firms (including subcontractors) must submit a Statement of Qualifications (General Professional Services Questionnaire) by the deadline. The latest professional services questionnaire may be obtained by contacting the Purchasing Department at (504) 364-2678 or via the Jefferson Parish website at www.jeffparish.net. This questionnaire can be accessed by hovering over “Business and Development” on the website and clicking on the Professional Services Questionnaires option under “Doing Business in Jefferson Parish”.
 
Submissions will only be accepted electronically via Jefferson Parish’s e-Procurement site, Central Bidding at www.centralauctionhouse.com or www.jeffparishbids.net.  Registration is required and free for Jefferson Parish vendors by accessing the following link: www.centralauctionhouse.com/registration.php.
 
No submittals will be accepted after the deadline.
 
Affidavits are not required to be submitted with the Statement of Qualifications but shall be submitted prior to contract approval.
 
Disputes/protests relating to the decisions by the evaluation committee or by the Jefferson Parish Council shall be brought before the 24th Judicial Court.

1.) Questionnaire: Will the questionnaire be considered confidential, or will it be a part of public record following award? ANSWER: Proposers are advised that except as otherwise provided by law, all documents submitted to the Parish under an SOQ are subject to the Louisiana Public Records Act, LSA- R.S. 44:1 et seq., and may be released when a public records request is made in accordance with the law. However, in accordance with LSA- R.S. 44:1 et seq nothing shall be construed to require the disclosure of proprietary or trade secret information. Furthermore, nothing shall be construed to require disclosure of any other information where an exception is provided for in LSA-R.S. 44:1 et seq. All records containing proprietary or trade secret information submitted by a developer, owner, or manufacturer to a public body shall contain a cover sheet that provides in bold type "DOCUMENT CONTAINS CONFIDENTIAL PROPRIETARY OR TRADE SECRET INFORMATION". The developer, owner, or manufacturer shall clearly mark each instance of information which is, in his opinion, proprietary or trade secret information. However, the determination of whether such information is in fact proprietary or trade secret information shall be made by the custodian within thirty days of a submission. 2.) Copy of CAP: We would like to request a copy of the most recent CAP, OMB CAP, and Departmental CAP ANSWER: Any proposer wanting to obtain access to the most recent CAP, OMB CAP, and Departmental CAP information or seeking access to the current fee to complete the parish-wide CAP can make a public records request as provided by law. 3.) Concerns: Does Jefferson Parish have any current concerns regarding their CAP process? ANSWER: The Parish has no concerns at this time. 4.) Cost: What is the current fee to complete the parish-wide CAP? ANSWER: Any proposer wanting to obtain access to the most recent CAP, OMB CAP, and Departmental CAP information or seeking access to the current fee to complete the parish-wide CAP can make a public records request as provided by law.

ANSWER: Jefferson Parish would consider anything clearly marked as proprietary as something that potentially could be proprietary. But, as stated in R.S. 44:1, the determination of whether such information is in fact proprietary or trade secret information shall be made by the Jefferson Parish within thirty days of a submission. Practically speaking the questionnaire itself is not going to be something we would agree is proprietary. Any proprietary info should be included under separate cover and clearly marked as confidential. I would say they can make reference to the confidential nature of the response in the questionnaire and then include the info under separate cover.

Question: I am preparing a response to your Cost Allocation Plan SOQ (No. 23-016). Would you like respondents to submit anything in addition to the General Professional Services Questionnaire? If so, what information would you like to see and in what format? ANSWER: In addition to the questionnaire, a document that would go more into depth addressing the criteria used to evaluate the proposal. The document should include a table of contents that directs the reader to each of the five evaluation criteria.
